1547
Santa Fe, 22 de Julio de 2005.
VISTO:
El Expediente N°
00701-0050789-9 del registro del Sistema de Información de Expedientes, por el
cual la Empresa “L BIS S.R.L”, titular del Permiso
Precario N° 249, solicita se autorice la prestación
de servicios a los Barrios “4 Bocas” y “Sargento Cabral”
de Santo Tomé como ramal de la línea principal; y
CONSIDERANDO:
Que mediante Resolución N° 3726/93 en el marco de la Ley N°
6310/67, la Dirección General de Transporte autorizó a las Empresas “MICRO
OMNIBUS LINEA L S.R.L.” y “L BIS S.R.L.”,
titulares de los Permisos Precarios N°s. 250 y 249
respectivamente, a cumplir un servicio coordinado entre el Pasaje 4 Bocas
jurisdicción de Santo Tomé-Santa Fe y viceversa;
Que por Decreto N°
3322/03, la Empresa “MICRO OMNIBUS LINEA L S.R.L.”
fue declarada caduca;
Que en su lugar, se autorizó en forma
experimental y precaria, a cumplir sus servicios, a la Empresa “SANTO TOME S.R.L.”;
Que posteriormente la Empresa “SANTO
TOME S.R.L.”, cede dicho ramal, en la participación
que le correspondía, a la Empresa “L BIS S.R.L,”, tomando
ésta a su cargo cuatro (4) empleados provenientes de la Empresa cedente;
Que con la nueva diagramación de
horarios a prestar, se dispone de frecuencias acorde a las necesidades de los
barrios 4 Bocas y Sargento Cabral de la ciudad de
Santo Tomé;
Que lo solicitado se encuentra previsto
dentro de las disposiciones legales vigentes;
Que han informado favorablemente las
áreas Técnica y Jurídica de la Subsecretaría de Transporte,
Que asimismo, ha tomado intervención la
Dirección General de Asuntos Jurídicos del Ministerio de la Producción;
POR ELLO:
EL GOBERNADOR DE LA PROVINCIA
DECRETA:
ARTICULO 1.- Autorízase
a las Empresa “L BIS S.R.L.”, titular del Permiso
Precario N° 249, que cumple servicios entre Santo
Tomé-Santa Fe y viceversa, de características Urbana-Interjurisdiccional,
a prestar servicios, como ramal de línea principal, entre los Barrios “4 Bocas”
y “Sargento Cabral” de jurisdicción de la ciudad de
Santo Tomé y hasta la ciudad de Santa Fe y viceversa, conforme a los horarios
detallados en el Anexo Unico que forma parte del
presente decreto.
ARTICULO 2.- Apruébase
la incorporación de siete (7) unidades como incremento del parque móvil, para
la realización de los servicios del ramal autorizado.
ARTICULO 3.- Este permiso podrá ser revocado en cualquier
momento, cuando concurran circunstancias especiales que así lo aconsejen y
obliguen, sin que la permisionaria tenga derecho a reclamo o indemnización
alguna.
ARTICULO 4.- Regístrese, comuníquese,
publíquese y archívese.
